CBUS Rewards Program Terms and Conditions
THESE REWARD PROGRAM TERMS CONTAIN A BINDING ARBITRATION PROVISION, CLASS ACTION WAIVER, AND JURY WAIVER THAT AFFECTS YOUR RIGHTS. THE ARBITRATION PROVISION REQUIRES THAT ALL DISPUTES BE RESOLVED IN INDIVIDUAL ARBITRATIONS OR SMALL CLAIMS COURT PROCEEDINGS. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. Further, these Terms are legally binding, limit Experience Columbus’s liability to you and require you to indemnify us. If you do not wish to be bound by these Terms and any Additional Terms, do not use the Service and uninstall our downloads and applications.
Experience Columbus reserves the right to change the terms and conditions of the Rewards Program at any time without notice, including the right to discontinue or change the benefits of the Rewards Program. If we make any material changes to these terms and conditions or terminate the Rewards Program, we will post the new terms here, and we may notify you by email or through the Rewards App. All Points and subsequent Rewards must be earned and used according to the terms and conditions of the Rewards Program as of the date the Points are earned.
1. Earning Points and Benefits as a CBUS Rewards Member (“Member”)
The Rewards Program is a free customer loyalty program that allows participants to earn points (“Points”) for every dollar spent on Eligible Product Purchases (as defined below). You may enroll in the Rewards Program at no cost by downloading our Rewards App here for iOS devices and here for Android devices or through the CBUS Rewards website. Points accrue when a Member’s unique CBUS Program Member Number is provided at the time of purchase for both in-store and online Eligible Product Purchases. Under the Rewards Program, “Eligible Product Purchases” means purchases of Experience Columbus products such as apparel, household items, and gifts, subject to any exclusions applicable at the time of sale or as stated herein. Gift card purchases are excluded. Members also have the ability to periodically earn bonus Points. Bonus Points help a Member earn Rewards faster, but do not contribute to a Member’s overall tier status. Experience Columbus has the sole right to make the final decision on whether a purchase qualifies for Points (or an action qualifies for bonus Points) under the Rewards Program.
Points earned above and beyond the limitations laid out in points earning system here will not be credited to member's account.
Points will typically post to Member’s Account within 48 hours from earning. No adjustments to Member’s Account will be made after 90 days from the actual purchase date. We make no representation that Points will post to a Member’s Account within a specific time frame or will be free from error.
Point calculations are based upon activities and purchases completed as listed on the Columbus Experience mobile app and CBUS Rewards website and are subject to change at any time.
Members do not earn Points for the amount of any Reward redeemed or discounts applied to an Eligible Product Purchase. When Members return products from which points were earned, Points previously posted to Member’s Account for that purchase will be deducted from Member’s Account. Other exclusions may apply. Points apply only to the first CBUS Rewards Program Member Number scanned in connection with any purchase. Points and Rewards have no cash value, are nontransferable, cannot be encumbered or conveyed by any means to anyone, and can only be redeemed as specifically permitted in connection with certain promotions. Points and Rewards may not be combined among CBUS Members and may not transfer through a Member’s estate and may not pass to Members’ successors and assigns. Points and Rewards do not constitute property or a property interest of the Member, and a Member does not have any other interest or right to them (including, without limitation, no community property interests apply to a spouse’s Rewards and they are not descendible upon death). Experience Columbus may revoke some or all Points and Rewards if it is determined, in Experience Columbus’ sole discretion, that a Member received Points and Rewards due to an error, through fraud, abuse, or deception, or in any manner not authorized or intended by Experience Columbus, or for any reason or no reason.
Members are solely responsible for ensuring that the contact information listed in their Member’s Account is accurate and valid. Experience Columbus is not responsible for Rewards or Points, lost or not credited, due to communication issues including change of address or other contact information or technical issues or malfunctions. Points that remain on Member’s account one (1) years from the date earned will be forfeited. If the Rewards Program is terminated or the Member’s account is closed, any remaining earned Points will be forfeited. Rewards are for one-time use only, and all redemptions are final. In the event that a Member returns merchandise that was partially or wholly paid for with a Reward(s), the Reward(s) used in connection with such a purchase shall not be reissued and no Points representing such Reward(s) shall be reissued to such Member’s Account. In these cases, the Member forfeits the Rewards(s) and the Points. The purchase of merchandise is also governed by the E-Commerce Terms.
CBUS Rewards Points Earning Structure
Social share – 1 pt.
Up to five shares per person, per week.
User cannot share the same experience within a week. However, it will be available to share again after 7 days.
Event check-in – 5 pts.
Up to five check-ins per person, per week.
Person cannot check into the same event more than once during the 7 day window, but can check in to more than one event per day.
Trail check-in – 10 pts.
Up to five check-ins per person, per week.
Person cannot check into the same trail more than once during the 7 day window.
Users can check into more than one trail per day.
Attraction check-in – 15 pts
Up to one check-in per person, per day
User can check in to the same attraction the following day.
Partner offer redemption – 15 pts
Up to two per person, per day.
Purchasing passes – 25 pts per pass
One booking per month.
Hotel booking – 50 pts per night
One booking per month.
2. Membership Eligibility and Cancellation
Any Points and Rewards in the account will be forfeited at the time of cancellation or suspension. Our failure to insist upon or enforce your strict compliance with these Rewards Program Terms will not constitute a waiver of any of our rights.
3. Redeeming Points Earned Under the Rewards Program
Points may only be redeemed through the CBUS Rewards catalogue up to the amount currently earned by member. Member may not go into negative points history for redemption.
Rewards are not valid toward prior purchases, certain products and services, the purchase of Gift Cards and eGift Cards, shipping costs, taxes or fees. Rewards are not redeemable for cash and no change or currency will be given for Reward redemption. Members may be notified of additional ineligible products and services. Other restrictions may apply. Lost, stolen, or expired Rewards will not be replaced. Redemption values and offers may be changed at any time without notice.
4. Binding Arbitration With Class Action Waiver
These Reward Program Terms contain a mandatory arbitration provision, class action waiver, jury waiver, and limitation of liability provisions more fully set out in Section 8 of Experience Columbus’s Terms and Conditions, which are incorporated here by reference.
5. Updates to Rewards Program Terms
These Reward Program Terms shall govern the Rewards Program as it applies to you from time-to-time. AS OUR REWARDS PROGRAM EVOLVES, THE TERMS AND CONDITIONS UNDER WHICH WE OFFER THE REWARDS PROGRAM MAY BE MODIFIED AND WE MAY CEASE OFFERING THE PROGRAM UNDER THE REWARDS TERMS OR APPLICABLE REWARDS ADDITIONAL TERMS FOR WHICH THEY WERE PREVIOUSLY OFFERED. YOU UNDERSTAND AND AGREE THAT EACH TIME YOU SIGN IN TO YOUR REWARDS PROGRAM ACCOUNT, OR OTHERWISE USE THE REWARDS PROGRAM (E.G. EARNING POINTS OR REDEEMING REWARDS), YOU ARE ENTERING INTO A NEW AGREEMENT WITH US ON THE THEN APPLICABLE TERMS AND CONDITIONS AND YOU AGREE THAT WE MAY NOTIFY YOU OF NEW TERMS BY POSTING THEM ON THE REWARDS APP (OR IN ANY OTHER REASONABLE MANNER OF NOTICE WHICH WE ELECT), AND THAT YOUR CONTINUED REWARDS PROGRAM MEMBERSHIP AFTER SUCH NOTICE CONSTITUTES YOUR GOING FORWARD AGREEMENT TO THE NEW TERMS FOR YOUR NEW USE AND TRANSACTIONS. Therefore, you should review the posted Rewards Program Terms, and any applicable Rewards Additional Terms, each time you use the Rewards Program. Any new Rewards Program Terms or Rewards Additional Terms will be effective as to new use and transactions as of the time that we post them, or such later date as may be specified in them or in other notice to you. However, the Rewards Program Terms, and any applicable Rewards Additional Terms, that applied when you previously transacted will continue to apply to such prior transactions (i.e., changes and additions are prospective only) unless mutually agreed. In the event any notice to you of new, revised or additional terms is determined by a tribunal to be insufficient, the prior agreement shall continue until sufficient notice to establish a new agreement occurs. In the event any tribunal finds any changed terms to be invalid, unenforceable or illegal, such will be severed to the extent necessary for the remainder to be valid and enforceable. You should frequently check the Rewards App and the e-mail you associated with your account, for notices, both of which you agree are reasonable manners of providing you notice. You can reject any new, revised, or additional terms by terminating your Rewards Program membership as set forth in Section 2, and continued membership constitutes acceptance of such terms.
6. Reaffirmation of Terms and Conditions
Each time that you participate in the Rewards Program by (i) earning Points, or (ii) redeeming a Reward, you are deemed to have re-acknowledged, accepted and agreed to these Reward Program Terms.
